New FNHURS Extension Could Help You Avoid a $10K Penalty

FNHURS now allows providers to request a new three-month extension. This enhancement comes at a critical time, as AHCA is entering the period when the automatic $10,000 fine for late filing established by last year’s legislative changes goes into effect.
Key points:
- The existing 30-day extension remains available. Providers must start a report in FNHURS to request it, though no data needs to be entered. This option disappears after the report due date.
- The new three-month extension may be requested any time before the due date, including after a 30-day extension (as long as they are not requested simultaneously).
- The three-month extension requires one of the following approved mitigation reasons:
- Natural disaster impact
- Pandemic impact
- Facility damage unrelated to a natural disaster
- Cyberattack affecting records or systems
- Declared bankruptcy
- Incomplete audited financial statements (audit opinion not expected to be signed before the due date)
This added flexibility gives providers more opportunities to remain compliant and avoid potential fines, as AHCA shall approve a waiver of the $10,000 fine due to the delays noted above.
